BMJ Masterclasses Terms and Conditions
All bookings are subject to the terms and conditions set out below.
When booking online, we only accept payment via credit or debit card. When booking offline via our hard copy registration form (which is available for download and print from our website or you can ask us to mail a copy to you) we will accept payment via credit or debit card or via cheque.
In these terms and conditions, 'we/our/us' shall mean the BMJ Publishing Group Limited, a private limited company with company number 03102371 having its registered address at BMA House, Tavistock Square, London, WC1H 9JR, UK. The person who is submitting the registration form must be authorised to accept all conditions as set out herein on behalf of those whose details are contained on the booking registration form.
1. BMJ Masterclasses
1.1. When you book to attend a BMJ Masterclass, your registration fee includes:
i. Entrance to the conference and workshops
ii. Lunch and refreshments
iii. Conference materials
2. Placing an order and our acceptance
2.1. When you register for a BMJ Masterclass (either by our receipt and acceptance of your completed online booking registration form or via our receipt and acceptance of your physical booking registration form), the language that we offer to you for the conclusion of this process will be English only.
2.2. When you submit you booking to us, this does not mean we have accepted your booking on a BMJ Masterclass. Our acceptance of your booking will take place as described in clause 2.3.
2.3. For online transactions you will be asked to input the details of your order, following input of your order details you will be given the opportunity to review this information and confirm or correct the information prior to the completion of your order. You will then be asked to submit card payment details. We will then process your payment via World Pay. We will send you email confirmation of receipt of your order and a copy of these terms and conditions. Submission of your booking is an offer which will be acknowledged in writing by the BMJ Publishing Group Ltd ("BMJ Group") who administers BMJ Masterclasses. Acceptance of the booking will take place when BMJ Group has received cleared funds for the BMJ Masterclass. This is when our contract comes into effect. The only exception to this is where we have received a booking request from you very close to the BMJ Masterclass date and we have agreed to allow you to attend, despite cleared funds having not been received. In those circumstances, the contract between us will come into effect when we confirm you are able to attend the BMJ Masterclass.
3. Travel & hotel arrangements
3.1. We urge you not to make non-refundable travel arrangements as the BMJ Group cannot be held responsible for non-refundable travel tickets. We suggest you make your refundable travel booking after you have received confirmation from the BMJ Group.
3.2. You shall have responsibility for your accommodation arrangements for the BMJ Masterclass. Bookings, cancellations or amendments to hotel arrangements should be made by directly contacting the hotel/accommodation booking agency.
4. Use of personal data
5. Prices and payments
5.1. The prices quoted on our website are inclusive of VAT (unless otherwise specified), which shall be payable on all bookings at the prevailing rate (VAT No 674 7384 91). Prices shall be valid for the period indicated on our website. All payments will be made in pounds sterling. For any delegates making payments from a bank account outside of the UK, your bank will convert the fee payable and the amount deducted will be subject to the exchange rate applied by your bank at that time.
5.2. Whilst we try to ensure that all of our prices on our website are accurate, errors may occur. If we discover an error in the prices of the products you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price or cancelling it. If you do not respond to our contact we will treat the order as Cancelled and in that circumstance you would receive a full refund. If you cancel and we have already processed your payment, you will receive a full refund.
5.3. Payments must be made through the method specified in these terms and conditions. We take all reasonable precautions to keep the details of your order and payments secure. Unless we are negligent, we cannot be held liable for losses caused as a result of unauthorised access to the information provided by you.
5.4. Please note that we may make a search with a credit reference agency, which will keep a record of that search and may share that information with other businesses. In the case of company bookings we may also make enquiries about the principal directors with a credit reference agency.
6. Cancellation, alterations, losses and refunds
6.1. Transfers from one delegate to another for the booked BMJ Masterclass will be permitted at any time. Transfers from BMJ Masterclass to another will be at the BMJ Group's absolute discretion.
6.2. Cancellation charges, for contracted bookings, are as follows:
6.2.1. If written notice is received 15 or more working days before date of the relevant BMJ Masterclass, a full refund will be given.
6.2.2. If written notice is received between 8-14 (inclusive) working days before the date of the relevant BMJ Masterclass, your fee will be refunded in full, less £50 administration charge. This administration charge will not apply if you have cancelled your booking within 7 working days or less after our contract comes into effect.
6.2.3. If written notice is received 7 working days or less prior to the relevant BMJ Masterclass, refunds will only be given in exceptional circumstances, and at the discretion of the BMJ Group. This is because we will have had to confirm numbers with the BMJ Masterclass venue and in most cases we will have had to pay for final numbers and will have started performing our services. You therefore hereby agree that in such circumstances, no refunds shall be permitted.
6.3. It may be necessary for reasons beyond the control of the BMJ Group to alter the content and timing of the BMJ Masterclass, the identity of the speaker, the date and/or the venue. In the unlikely event we cancel (as opposed to postpone) the BMJ Masterclass for which you have booked, we will refund you the registration fee but to the fullest extent permitted by law, we will not be liable to you for any other costs or losses, whether direct or indirect. This does not affect your statutory rights. In addition to the fullest extent permitted by law we will not be liable to you for any losses (whether direct or indirect) based on reliance on any content at event and to the fullest extent permitted by law the BMJ Group disclaims all warranties regarding the event, whether express or implied (including by statute).
6.4. Notwithstanding the other provisions in this contract our liability shall be limited to the booking fee and we shall not be liable for any indirect or consequential loss. Nothing within this contract shall be taken to exclude or limit our liability for death, personal injury, fraudulent misrepresentation or where such limitation of liability is otherwise not permitted by law.
7. Venue rules
You will need to comply at all times with the rules and regulations imposed by the venue and may be excluded or removed from the conference for failure to adhere to such requirements. You will also need to ensure that you have your own insurances against any loss to your property or any loss or damage you may cause at the conference.
If you breach these conditions and we take no immediate action, this will not be deemed a waiver of our rights and we will still be entitled to take further action at a later time.
9. Events beyond our reasonable control
Should the BMJ Group be unable to perform any obligations under these terms and conditions due to causes or circumstances beyond its reasonable control, including but not limited to any Act of God, war or threatened war, terrorism or threatened terrorism, fire, flood, drought, strike, lock out or actions of the venue, they will not be liable to you for any losses or claims arising from this.
We may transfer our rights and obligations under these Terms and conditions to another organisation, and We will always notify you in writing if this happens, but this will not affect your rights or Our obligations under these Terms.
11. Entire Agreement
To the fullest extent permitted by law, these terms and conditions constitute the entire agreement between you and BMJ Group with respect to the BMJ Masterclass being booked.
These conditions cannot be changed or terminated orally, and no changes or amendments to these conditions shall be binding until accepted by both you and BMJ Group in writing (which includes by fax and email).
13. Exclusion of Third Party Rights
The contract is between you and us. No other person shall have any rights to enforce any of its terms. There shall be no right whatsoever for any third party to enforce these conditions. You and the BMJ Group hereby expressly wish to exclude the operation of the Contracts (Rights of Third Parties) Act 1999.
